Topic: Mission possible: Non-foreign related disputes under PRC Law submitted to Hong Kong Arbitration?

According to current PRC laws, only disputes with foreign-related elements are allowed to be governed by foreign laws and to be submitted to foreign arbitrations. As the only common law jurisdiction in the PRC, Hong Kong Law and Hong Kong Arbitration are deemed as "foreign law" and "foreign arbitration".

Hosted by HKIAC on Tuesday, 17 October 2023, from 1:00 pm to 3:00 pm HKT, this is the only Chinese Session being held during Hong Kong Arbitration Week. The session will focus on the following topics:

• What are "foreign-related disputes" under PRC law?
• Why non-foreign related disputes under PRC law are not allowed to be governed by foreign laws and submitted to foreign arbitrations?
• Will this rule bind tribunals of Hong Kong arbitrations or arbitrations seated in other jurisdictions?
• Do Hong Kong and other jurisdictions have similar rules? 
• Non-foreign related disputes under PRC Law submitted to Hong Kong Arbitration: possibilities and approachs?
