The Mediation Ordinance ("MO") does not specifically use the word "facilitative". However, the definition of "mediation" as stated in Section 4 of MO is the facilitative model. Disputes vary and there is no one-size-fits-all resolution model. The fact that there are different models of mediation says it all. Evaluative skills are useful in mediation. Some parties in fact expect and request the mediator to evaluate their cases.
What are the cases suitable for Evaluative Mediation? Should it be applied to healthcare and personal injury disputes? These questions will be addressed in the Seminar. After the presentations, there will be a Panel Discussion during which two very experienced mediators/ advocates and a mediator/ surgeon will share their experience and views from different perspectives. This will be followed by a Q&A session .
This Webinar will be run in English from 06:30pm to 08:00pm on 17 August 2021 (Tuesday), and targets mediators, lawyers, healthcare workers and anyone who is interested in knowing more about the topic of Evaluative Mediation. Prof. LEUNG Hing Fung
Chairman of the Evaluative Mediation Working Group, HKMC
HF is a past Chairman of HKMC and is a Professor of Practice (Arbitration and Dispute Resolution) at the University of Hong. He is also a practicing mediator, arbitrator and barrister. He is a general accredited mediator in the Panel of Hong Kong Mediation Accreditation Association Limited (HKMAAL); an arbitrator in the Panel of Hong Kong International Arbitration Centre and the Joint Panel of Hong Kong Institute of Architect and Hong Kong Institute of Surveyors. HF is a frequent contributor to journals and seminars.
Ms. Nancy LEUNG
Partner, Leung & Lau
Ms Leung is a founding partner of Leung & Lau, and deals with a wide range of civil litigation matters. This includes international trade disputes, commercial disputes, breach of contracts disputes, tortious claims, etc.
Nancy obtained her LL.B. (Hons) and P.C.LL. from the University of Hong Kong (top student in second year and second place overall) and her LL.M. from the University of Cambridge, England. She has been awarded a significant number of academic prizes and scholarships throughout her studies.
As an accredited general mediator, Nancy has always been interested in Alternative Dispute Resolutions and had participated in various ADR including arbitrations and mediations.
She has also given talks on the CJR highlighting the importance and advantages of mediation to clients and is arranging talks on mediation to various clients to promote the same.
In addition to practising, Nancy is a frequent speaker on legal matters, in both Hong Kong and abroad and has taught as a part-time lecturer and tutor at the Vocational Training Council, the University of Hong Kong and the City University.
Nancy has also acted as one of the coaches for the Mediation Training Workshop organized by The Law Society to train lawyers to be accredited mediators.
Mr. Chris HOWSE
Partner, Howse Williams
Mr. Howse is a Senior Partner of Howse Williams. He is a dispute resolution lawyer who handles a wide range of commercial, insurance, professional indemnity and maritime disputes. He has practised as a dispute resolution lawyer in Hong Kong for 40 years. He is a qualified arbitrator in Hong Kong and many other Asian jurisdictions. He is an accredited mediator on a number of mediation panels. He has acted as a mediator and represented clients in both facilitative and evaluative mediation.
Dr. James CHIU
Member of the Evaluative Mediation Working Group, HKMC
Dr. Chiu, LLB (Hons) Lond, Specialist in General Surgery, is a mentor mediator, collaborative practitioner and Hon Clinical Assistant Professor of Hong Kong University. He was appointed the first Adjunct Assistant Professor in mediation courses at CUHK in 2010. James has published many articles and book chapters on mediation, negotiation, apologies, medical ethics and medico-legal topics, both in Hong Kong and abroad. He has chaired/ spoken in over 100 local and international meetings on those topics
