HKMC Webinar: Deploying Mediation Skills in the NEC Contract Administration - 06:30pm, Tuesday 30 May 2023
New Engineering Contract ("NEC") as a relatively new standard form of contract in Hong Kong has been adopted by many government construction projects and promulgated in the construction industry. NEC is said to be more oriented to project management approach and dispute avoidance. To make the most out of the new contracting system, project personnel have to adopt a new culture away from the adversarial mindset in the contract administration. They have to exhibit more cooperative attitudes and adopt many of the amicable skills that are used in mediation. Hence, it is believed meditation skills do play an important role either purposefully or subconsciously in the NEC contract administration. In this seminar our speakers will share their experience in using NEC in their projects and particularly highlight the actual situations and potential opportunities that mediation skills could contribute to the successful administration of NEC contact for construction projects in Hong Kong.

Gerrard
Senior NEC Consultant and Secretary, NEC Users’ Group
Robert is an Accredited Mediator and Dispute Resolution Adviser who specialises in NEC contracts, both setting these up and successfully managing them. He has 40 years’ experience in contract management and carries out training and consultancy around the world. Robert is based in Hong Kong and works as a Senior Consultant for Thomas Telford Limited.
He is an examiner for the Institution of Civil Engineers Certificate in Law and Contract Management course and has also held the position of NEC Users’ Group Secretary from 2006 to date. Robert was an NEC4 Contract Drafter, part of the NEC3 contracts working group and an Accredited NEC4 ECC Project Manager.
Robert’s publications include NEC3 and NEC4 Compared (2017), NEC2 and NEC3 Compared (2005), joint author in NEC4 Avoiding and Resolving Disputes (2019), NEC4 Practical Solutions (2017) and NEC3 Practical Solutions (2015).

Mohammed’s practice focuses on international and domestic arbitration in the construction industry. He specializes in providing mid-project support for clients in the infrastructure sector to help them manage, develop and resolve issues prior to the need for formal dispute resolution including through both voluntary mediation and court mandated mediation in respect of construction litigation in Hong Kong. He has been involved in a wide range of construction disputes in the region acting under the HKIAC Domestic Rules, HKIAC Administered Rules and ICC Rules. He is a Solicitor Advocate, a Fellow of the CIArb and is on the HKIAC List of Arbitrators, the Panel of Arbitrators of the eBRAM ODR Scheme and the Primary Panel of Arbitrators of the Maldives International Arbitration Centre.

Prof. Edwin Chan will be the Moderator at this Seminar.
Edwin obtained his PhD degree on dispute management at the King’s College of London University. He is a Chartered Architect/Surveyor/Engineer and is called to the BAR of both the English and Hong Kong. He has been a Professor of the Department of Building and Real Estate of Hong Kong Polytechnic University since 2004 (Adjunct Professor since 2021) and an Adjunct Professor of the Faculty of Architecture (HKU). He has carried out a wide range of research including: Urban renewal, Green building, and Dispute Management. He has published over 150 SCI/SSCI international journal papers. Currently, he is the Discipline Leader for Sustainability Policy and Law, and Deputy Programme Leader of the MSc in Construction Law and Dispute Resolution. He is an accredited Mediator and Listed Adjudicator/Arbitrator of the Hong Kong International Arbitration Centre (HKIAC) and a Dispute Resolution Advisor (Dev. Bureau List). He has also played active roles in professional bodies and served several government committees.
