Sebastian is a Fellow of CIArb and a WIPO Approved Neutral. He is an Arbitrator and Mediator with WIPO, HKIAC (Panel of Arbitrators for Intellectual Property Disputes; Panel of Emergency Arbitrators; List of Arbitrators), SCIA, SHAC and AIAC. Sebastian is a Domain Name Panelist with WIPO, FORUM, HKIAC, ADNDRC and AIAC, rendering decisions in both English and Chinese.

Sebastian has a broad civil litigation, arbitration, and mediation practice, including intellectual property, commercial, white collar fraud, insolvency, company, employment, matrimonial finance, and costs/taxation matters.

Sebastian was admitted to practice as a solicitor in Victoria, Australia in 1998 and in Hong Kong in 2003. Prior to being called to the bar, he was a partner in an international law firm.

Sebastian is a fluent Putonghua speaker.

Theresa is a Partner in the IP Commercial & Litigation Practice.

Theresa’s practice covers IP protection and enforcement in Hong Kong in the areas of trade mark, patents, registered designs, passing off, copyright, trade secrets and confidential information, company names and domain names and is one of the few lawyers in Hong Kong specialising in patent litigation where her science background has proved to be invaluable.

Theresa also advises on a wide range of IP commercial and local law compliance matters relating to clinical trials, advertising, marketing campaigns, product launches, consumer protection, copyright clearance, privacy and personal data protection, sale of goods, product guarantees and trade description and unfair trade practices.

Theresa is qualified as a solicitor in Hong Kong and holds a JD from the Chinese University of Hong Kong and a PCLL from Chinese University of Hong Kong. She also obtained an Hon BSc in Life Sciences from the University of Toronto, specialising in Human Biology and Nutritional Science.

Nicolas Wiegand is Co-Head of the firm's dispute resolution group, Head of APAC International Arbitration and Managing Partner of the CMS Hong Kong office. He is based out of Hong Kong, San Francisco and Singapore.

Nicolas is specialised in international commercial and investment arbitration with a focus on corporate, post M&A, joint venture, commercial, sales and distribution and IP disputes as well as the energy, pharmaceutical, medical products and equipment, automotive, construction and infrastructure sectors. He is particularly experienced with arbitration in or in relation to Asia, specifically Hong Kong, Singapore, Korea, China, Japan, Australia, Taiwan, Vietnam, Thailand and Indonesia as well as other South-East Asian jurisdictions.

Nicolas has so far acted in more than 140 international arbitrations under all major arbitration rules (mainly ICC, HKIAC, SIAC, KCAB, JCAA, AAA and DIS but also LCIA, DIAC, ASA, VIAC, SCC and others) as well as in ad hoc arbitrations.

Alongside his work as a party representative, Nicolas is an experienced arbitrator. To date, he has acted as arbitrator in 38 international arbitration cases and additionally also served as an emergency arbitrator. The matters he has sat in cover a wide range of jurisdictions, including Hong Kong, Korea, Japan, Singapore, Germany, Switzerland, Vietnam, the U.S. (California and New York), the UAE, Kuwait, Qatar, Mongolia, Sri Lanka and other jurisdictions in Europe, Asia and the Americas. He has extensive experience with all major arbitral institutions and rules as well as with sitting at the major arbitration hubs worldwide.

Nicolas is regularly engaged as a speaker at international arbitration conferences, and he runs training courses for arbitral institutions.

He joined CMS in 2006 and was made partner in 2013. In 2009/2010, he was seconded to Clayton Utz in Sydney. He now leads the firm’s arbitration practice for the Asia-Pacific region. In January 2020, he has also been appointed as co-head for the overall CMS dispute resolution practice.

Eric is Deputy Secretary-General at HKIAC.

Prior to joining the HKIAC, Eric worked for several years as a barrister-at-law in Hong Kong focusing primarily on international commercial and construction arbitrations, as well as general commercial litigation in Hong Kong, and has worked as counsel as well as tribunal secretary for several major international commercial, construction, and financial arbitrations around the world.

In addition to his work as a barrister, Eric was previously Adjunct Professor at the University of International Business and Economics in Beijing, lecturing in advocacy and investor-state arbitration. He has also lectured at Tsinghua University and Peking University. Eric has also published on issues of international dispute resolution and investor-state arbitration.

Eric holds a BCL from Oxford University, PCLL and JD from City University of Hong Kong, MSc E-commerce from the University of Hong Kong, as well as a BS in Business Administration and Information Systems from Babson College in the USA. He is admitted to practice law in Hong Kong.
