This webinar covers the scope of the Hong Kong-Mainland China Interim Measures Arrangement; its practical application; the effect of the arrangement on Mainland China-related contracts; and HKIAC's experience.
The Arrangement allows any party to an arbitration seated in Hong Kong and administered by a qualifying institution, including HKIAC, to apply to a Mainland Chinese court for the preservation of assets, evidence or conduct.
This development is a game changer for parties to arbitral proceedings in Hong Kong. It is the first and only mechanism under which parties to arbitrations seated outside of Mainland China have access to the Mainland Chinese courts for interim relief.
HKIAC has already processed applications seeking to preserve assets worth a total of RMB 5.9 billion (USD 836 million) in Mainland China.

Secretary-General at HKIAC
Sarah Grimmer is Secretary-General of the Hong Kong International Arbitration Centre (HKIAC). She was formerly Senior Legal Counsel at the Permanent Court of Arbitration (PCA) where she acted as registrar in several inter-State arbitrations under the Law of the Sea Convention and served as tribunal secretary in multiple investment treaty arbitrations and contract-based claims.
Prior to joining the PCA, Sarah served as Assistant Counsel at the ICC International Court of Arbitration in Paris. She was also a member of the international arbitration group at Shearman & Sterling LLP in Paris, prior to which she worked in private practice in Auckland.
In 2015, Sarah was appointed to the Special Tribunal for Lebanon Disciplinary Board. She is a member of the ICCA-ASIL Task Force on Damages (2016), ICCA Publications Committee (2015), the IBA Investment Arbitration Subcommittee (2014), New Zealand ICC Arbitration Committee (2014), and the IBA Arb40 Steering Committee (2013).
Helen H. Shi

Helen Shi’s practice focuses on dispute resolution, including international commercial arbitration and litigation.
Recognized by Chambers & Partners as “an icon of arbitration”, Ms. Shi has handled more than 100 cases, representing many multinational companies and large domestic enterprises in a breadth of disputes, including equity acquisitions, oil and gas projects, hotel management, aircraft leasing, and construction disputes in litigation before Chinese courts and in arbitration cases before the ICC, the AAA, SIAC, HKIAC, CIETAC and ad hoc arbitrations under UNCITRAL rules.
Ms. Shi has also participated as an arbitrator in nearly 50 cases. Being an experienced legal practitioner, she has also provided Chinese legal opinions and testified as an expert in a number of China-related overseas court cases and arbitrations, including court proceedings in Hong Kong and Canada as well as arbitration conducted before HKIAC and an ad hoc tribunal in London.

Ing Loong Yang is a partner in the Hong Kong office of Latham & Watkins and a member of the Litigation & Trial Department. His practice focuses on international arbitration and complex commercial litigation in Asia, particularly on cross-border disputes involving Greater China.
Mr. Yang has extensive experience acting for corporate clients, which includes: International arbitration, Complex commercial litigation, Shareholders’ and joint venture disputes, Technology and other licensing disputes, FCPA investigation and compliance, and Regulatory issues.
He has represented clients in numerous international arbitrations under the rules of CIETAC, SIAC, ICC, HKIAC, and UNCITRAL, as well as in the Hong Kong courts. Mr. Yang is a solicitor advocate of the Hong Kong courts, with full rights of audience in the Hong Kong courts. Mr. Yang is also qualified in England and Wales, Singapore, and New York.
