The Hong Kong Mediation Council (HKMC) intends to host a series of webinars entitled "Mediation Insight Series" in order to update the knowledge of mediators and hone their practical skills. Due to the ongoing COVID-19 pandemic, the seminars will not be held physically but conducted online via ZOOM.
Construction disputes are characterized with its complexity and very often the parties would choose to resolve the dispute by way of litigation or arbitration. Given the cost and time involved in an arbitration or litigation is large, how would mediation help the parties to resolve or narrow down the differences in a more effective way? In the talk, the two prominent speakers will share with us their experience in what types of construction dispute are more effective in adopting mediation to resolve the dispute rather than arbitration or litigation, from the perspective of an arbitrator and the party's legal representative, with examples based on the cases they involved.
This webinar session will be moderated by Mr. CHEUNG Tat Tong, JP. Mr. Cheung is a past chairman of HKMC's Construction Mediation Interest Group.
The target audience is General Mediators and Legal Practitioners including In-House Counsel.

K.K. has wide experience in dealing with a variety of private and government building projects in Hong Kong, some of which was gained when practising as a quantity surveyor. He also acts for developers, contractors and subcontractors in construction projects, in litigation, arbitration and mediation and undertakes general advisory work in relation to construction contracts in Hong Kong, Macau and Mainland China. He conducts CIETAC arbitrations in Shenzhen, Shanghai and Beijing and acts as an arbitrator and mediator in construction and commercial disputes. Damon So is initially qualified as a Chartered Civil and Structural engineer. Since becoming qualified as a lawyer with the Construction and Engineering practice, he has advised clients on the full remit of issues that clients may face in the construction sector. Advising on both contentious and non-contentious issues, he has particular experience in the areas of arbitration, litigation, and alternative dispute resolution.
In terms of contentious work, Damon has handled a large amount of litigation and arbitration, acting for statutory bodies, employers, contractors, consultants, and insurers, in respect of building and civil projects and in commercial disputes. He acts as an arbitrator and is a HKMAAL Accredited Mediator.
Damon is a popular speaker and has been invited regularly over the years by various professional organisations and professional and engineering companies to speak on topics relating to construction, arbitration, and dispute resolution.
